Item Title:      Encroachment Agreement with the Raleigh Housing Authority at Crosby-Garfield School

 

 

Specific Action Requested:

That the Board of Commissioners approves an encroachment agreement with the Raleigh Housing Authority for the installation of one brick column and connecting fence panels on the Crosby-Garfield property subject to terms and conditions satisfactory to the County Attorney.

 

 

Item Summary:

 

The Raleigh Housing Authority (RHA) has recently completed the redevelopment of Chavis Heights located on East Lenoir Street with the construction of new apartments and townhouses. The Chavis Heights redevelopment project is located adjacent to the County-owned Crosby-Garfield School Building currently being used by Human Services for multiple programs.

 

The Chavis Heights project included the construction of a decorative fence and brick columns surrounding the property. During construction, a column at the rear corner of the property was mistakenly located across the property line and therefore encroached upon the Crosby-Garfield property. Upon discovery of this error, an additional column was constructed on the Chavis Heights property and the Raleigh Housing Authority has offered to remove the encroaching column.

 

The Crosby-Garfield property is surrounded by an existing chain link fence located along the common line with Chavis Heights. If the new RHA fence remains entirely on their property it will create an approximate 4 foot gap between the new fence and the existing chain link fence. Upon site visit and continued discussions with RHA, it was determined that this would likely create an open pathway between the two properties running from Chavis Way to Lenoir Street. It was agreed that the two fences should be connected to discourage this use.

 

Therefore the Raleigh Housing Authority has requested that RHA and Wake County enter into an encroachment agreement to allow for the brick column located on County property to remain and for the installation of fence panels to connect the existing chain link fence to the new fence on the Chavis Heights property.
